CINCINNATI (WKRC) – The criminal charge against a man who was considered both a suspect and a victim in a violent downtown Cincinnati brawl last summer has been dismissed.
The charge against Alex Tchervinski was dropped after two subpoenaed witnesses failed to respond and did not appear in court.
This marked the third unsuccessful attempt to move forward with the trial.
“This dismissal should have happened months ago, and the charges should never have been filed,” said Tchervinski’s attorney, Doug Brannon. “We’re very pleased with the outcome. Alex is relieved to finally move past this chapter of his life. Now, the focus can shift to those truly responsible for attacking Alex and his friends that night.”
Tchervinski had been facing a misdemeanor disorderly conduct charge, which carried a possible sentence of up to 30 days in jail.
He was accused of slapping one of seven other individuals involved in the incident during the early morning hours of July 26. That moment, along with much of the violence that followed, was recorded on cell phone video.
The footage also captured an attack on a woman named Holly, who was injured during the altercation.
Six others accused of participating in the brawl still face charges, including felonious assault, assault, and aggravated riot.

Dekyra Vernon
Gregory Wright
Gregory Wright is charged only with aggravated riot and aggravated robbery. The group is scheduled for a bench trial on May 11.
Dominique Kittle has been ruled incompetent to stand trial and is expected to return to court in September.
